Super temporary workers, what is that, you may ask? In many sectors, highly trained specialists have carved out a niche for themselves. They take on temporary assignments for companies. On site, to replace a person who is absent, to give the company an injection of know-how or to contribute to a project. These specialists deliberately and consciously go into self-employment. This area is particularly well known in the modern areas of the so-called new economy. The freedom to decide for themselves who they work for and for how long, as well as the location of the service provision, are decisive factors for consultants in this type of professional practice. However, this innovative HR tool is also becoming increasingly popular in traditional sectors. In the field of legal services, other exciting areas have emerged alongside traditional legal advice, which are in high demand due to the constant changes in regulatory requirements. Especially in the areas of compliance, data protection, contract and risk management. Companies have an enormous need for well-trained specialists in these areas. Companies are increasingly meeting this demand flexibly with temporary assignments. The reason is obvious: fast, flexible deployment without extensive training and immediate availability. These super temporary workers are placed by personnel service providers. They contractually interpose themselves between the interim manager and the company or conclude a contract with both for a brokerage fee. Under German law, this raises the question of integration into the company's organizational process and the associated question of a possible bogus self-employment. The law on contracts for work and services and the illegal hiring out of employees are the key words to be considered here. For the lawyer working as an interim manager, questions of compatibility with professional law also arise and the drafting of contracts needs to be carefully considered. This study presents the field of legal interim management and identifies possible conflicts with the professional law of lawyers. The insights gained are enriched by the author's experience as a legal interim manager and then lead to a proposal for a draft contract.
