The regulation applies to traditional online ads as well as social media formats. Platform providers will also be required to implement technical verification mechanisms to ensure compliance. Violations may result in sanctions.

Under Article 50 of the AI Act, the European Union has established a mandatory requirement that AI-generated content—particularly if it is potentially deceptive or misleading—must be clearly labeled. The Digital Services Act complements this regulation with additional obligations for platforms.
In Germany, this requirement is already in effect.
