Labeling Requirements: South Korea Follows Europe's Lead on AI

What South Korea Is Introducing Now—and Why It Won't Be an Isolated Case

Starting in early 2026, South Korea will require mandatory labeling for advertisements generated by artificial intelligence. Whether it’s an image, text, or video—if content is fully or partially AI-generated, it must be clearly labeled as such for users.

The regulation applies to traditional online ads as well as social media formats. Platform providers will also be required to implement technical verification mechanisms to ensure compliance. Violations may result in sanctions.

The goal is clear:
Consumer protection, transparency, and the curbing of manipulative content are at the heart of the initiative.

What many overlook: Europe set the pace

The South Korean regulation is no coincidence—it is a direct response to developments in the European Union.

Under Article 50 of the AI Act, the European Union has established a mandatory requirement that AI-generated content—particularly if it is potentially deceptive or misleading—must be clearly labeled. The Digital Services Act complements this regulation with additional obligations for platforms.

In Germany, this requirement is already in effect.

Companies must ensure that:

  • AI-generated content is clearly identifiable as such

  • Users know at all times whether they are interacting with generated ads

  • Image material, synthetic voices, generated videos, or text must be labeled accordingly

  • Establish effective control processes on platforms

South Korea is thus following a clear European line—and giving it global reach.

Implement the requirements of the AI Act!

Where the market is headed

The decision from Seoul shows that transparency in AI communication is no longer a regional issue. It is becoming a global standard.

For companies, this means:

  • The days of non-disclosure are over: Anyone who uses AI in advertising must systematically disclose it

  • Global brands must adopt a multilocal approach: Similar requirements apply in South Korea and the EU—even if the wording differs

  • Responsible communication becomes a mindset: Openness toward consumers and stakeholders is not a reputational risk, but a competitive advantage

The labeling requirement is more than just a legal technicality—it reflects a new expectation of credibility.

What Companies Should Do Now

AI generated content

For marketing executives and communications departments, the question is not whether to use AI—but how transparently and in compliance with regulations this is done.

Our advice:

  • Review all AI-based campaigns and tools: What content is generated automatically? Where is labeling required?

  • Establish internal processes and responsibilities: Make labeling an integral part of your production and approval chains

  • Rely on well-thought-out governance rather than ad hoc solutions: We help you build sustainable structures that work across all jurisdictions

  • Use transparency as a brand promise: Companies that are open about their use of AI build trust—with customers, employees, and regulators
